Wonder 4 Marketing Inc. is a Florida corporation providing digital marketing services including but not limited to: advertising management (Google Ads, Meta Ads), search engine optimization (SEO), web design and development, lead generation, and marketing consulting. We are headquartered at 7500 NW 25th St, Suite 237, Miami, FL 33122.

2. Eligibility

By using our Site and services, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using our services on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

3. Services

The specific scope, deliverables, timeline, and pricing of our marketing services will be outlined in a separate Service Agreement or Statement of Work between you and the Company. These Terms apply in addition to any such agreement.

3.2 No Guaranteed Results

IMPORTANT: All marketing results described on this website, including case studies, testimonials, and statistics, are based on past client experiences and are presented for illustrative purposes only. We do not guarantee specific results. Marketing outcomes vary based on numerous factors including market conditions, competition, budget, industry, geographic location, and the quality of the client's business operations. Past performance does not guarantee future results.

3.3 Third-Party Platforms

Our services involve third-party platforms including but not limited to Google Ads, Meta (Facebook/Instagram), Google Analytics, and other tools. These platforms have their own terms of service and policies. We are not responsible for changes to third-party platform policies, pricing, features, or availability. You agree to comply with all applicable third-party platform terms when using our services.

4. Website Use

4.1 Permitted Use

You may use our Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law
  • Attempt to gain unauthorized access to any portion of the Site or its systems

6. User Content and Submissions

By submitting any content to us through our forms, email, or other channels (including testimonials, reviews, or feedback), you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display such content for our business purposes, including marketing and promotional materials.

8.3 WhatsApp

By providing your WhatsApp number, you consent to receive messages via WhatsApp Business. WhatsApp communications are subject to Meta's terms and our Privacy Policy.

9. Payment Terms

Payment terms for our services will be specified in your Service Agreement. General terms include:

  • All fees are in U.S. Dollars (USD)
  • Advertising spend is paid directly to the advertising platform (Google, Meta) and is separate from our service fees
  • Service fees are non-refundable once work has commenced, unless otherwise stated in your Service Agreement
  • Late payments may incur interest at the rate of 1.5% per month or the maximum rate permitted by law

10. Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free
  • Any specific marketing results will be achieved
  • Third-party platforms will remain available or unchanged
  • Content on the Site is accurate, complete, or current

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WONDER 4 MARKETING INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Wonder 4 Marketing Inc. and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

13.2 Jurisdiction

Any legal action arising out of these Terms shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida. You consent to the personal jurisdiction of these courts.

13.3 Informal Resolution

Before filing any legal claim, you agree to attempt to resolve any dispute informally by contacting us at info@wonder4marketing.com. We will attempt to resolve the dispute within 30 days.

14. Termination

We reserve the right to suspend or terminate your access to the Site at any time, with or without cause, and with or without notice. Upon termination, your right to use the Site ceases immediately.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and SMS Policy, constitute the entire agreement between you and Wonder 4 Marketing Inc. regarding the use of our Site. Any separate Service Agreement for marketing services will take precedence over these Terms in case of conflict regarding the scope of services.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
